Terms of Use

1. Agreeing to these Terms#

By downloading, accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service. The App and the Web App are licensed to you, not sold. If you got the App from Apple's App Store, your use of it is also subject to Apple's Media Services Terms and Conditions, and Apple's Standard Licensed Application End User License Agreement applies to anything these Terms do not cover. If the two conflict, these Terms apply to the extent the law allows.

2. Who can use QuizWhiz#

You must be at least 13 years old to use the Service. If you are under the age of majority where you live, you may use the Service only with the permission of a parent or guardian, who agrees to these Terms on your behalf. You may not use the Service if the law where you live prohibits it.

3. Your account#

You can create an account with Sign in with Apple, Sign in with Google or with email, and use the same account in the App and the Web App. Please give accurate information and keep your login secure. You are responsible for activity under your account, so tell us right away at support@quizwhizai.com if you think someone else has accessed it. You can delete your account at any time in the App or the Web App under Settings → Delete Account.

4. Free and Pro plans#

Free. The free plan lets you try every feature on 3 study sets.

Pro. Pro is an auto-renewing subscription. You can buy it in the App, through Apple's App Store, or in the Web App, where payments are processed by our payment partners RevenueCat and Stripe. Prices may differ between the two and may include or exclude tax depending on where you live.

Pro bought in the App (App Store)

By subscribing in the App, you agree that:

• Payment is charged to your Apple ID when you confirm the purchase.
• Your subscription renews automatically at the same price and length unless you cancel at least 24 hours before the end of the current period. Your account is charged for renewal within the 24 hours before the period ends.
• You can manage or cancel it in your device's Settings: tap your name, then Subscriptions, and choose QuizWhiz. Pro stays active until the end of the period you paid for.
• If a free trial is offered, any unused part of it ends when you buy a subscription. If you don't cancel before the trial ends, it converts to a paid subscription.
• Apple handles all payments and refunds under its own policies, so refund requests go to Apple. We cannot issue refunds for App Store purchases.

Pro bought in the Web App

By subscribing in the Web App, you agree that:

• Payment is charged to the payment method you enter when you confirm the purchase.
• Your subscription renews automatically at the same price and length, and your payment method is charged at the start of each new period, unless you cancel before the current period ends.
• You can manage or cancel it at any time from your account in the Web App, or from the link in your purchase receipt email. Pro stays active until the end of the period you paid for.
• If a free trial is offered, it converts to a paid subscription when it ends unless you cancel before then.
• Refund requests for Web App purchases come to us at support@quizwhizai.com. We handle them fairly and as the law where you live requires, including any right you have to withdraw from the purchase.

Prices and plan features may change. For App Store subscriptions, Apple will tell you about price increases as its rules require. For Web App subscriptions, we will tell you by email before a new price applies. Either way, you can cancel before the change takes effect. A subscription bought in one place is managed and cancelled there: cancelling in the App does not cancel a Web App subscription, and the other way round.

5. Your content#

“Your content” means the recordings, files, scans, text and links you add to the Service. You keep all of your rights in your content.

To run the Service, you give us a worldwide, non-exclusive, royalty-free license to host, store, copy, process, transmit and display your content, and to create study material from it. This includes sharing it with our service providers as described in our Privacy Policy. We use this license only to provide the Service to you, and it ends when you delete the content or your account, except for backup copies we remove on a schedule.

You promise that:

• You have the rights you need to add your content and to let us process it as described here.
• You are allowed to record any lecture you record. Some schools, instructors and laws require permission or consent before recording. You are responsible for getting it.
• Your content does not break any law or anyone else's rights, including copyright and privacy.

Content you reach through a link, such as a YouTube video, belongs to its owner and is subject to that site's terms. Use it for your own study only.

6. AI-generated study material#

QuizWhiz uses AI to create transcripts, notes, study guides, memory tricks, quizzes, flashcards, readiness estimates and podcasts. AI can be wrong, incomplete or out of date, and two people may get similar results from similar material.

Study material from QuizWhiz is a study aid. It is not a substitute for your instructors, your course materials or professional advice. That includes medical, nursing, pharmacology, legal and financial topics. Always check important information against your course. Readiness scores and predictions about what may be on an exam are estimates, not promises about your grade.

Between you and us, you may use the study material created for you for your own personal study.

7. Acceptable use and academic integrity#

Use QuizWhiz to learn. You are responsible for following your school's academic integrity rules and honor code, including any rules about AI tools, recording and sharing course materials. You agree not to:

• Use the Service during an exam or assignment where that is not allowed, or to cheat or commit fraud
• Upload content that is illegal, harmful, harassing, or infringes someone else's rights
• Record people where you don't have the right or consent to do so
• Copy, sell, resell or redistribute the Service or course materials you don't have the right to share
• Reverse engineer, decompile or try to extract the source code of the App, except where the law allows it
• Get around free-plan limits or subscription checks, or share accounts to avoid paying
• Scrape, overload, interfere with or break the security of the Service
• Use the Service to build a competing product

8. Our intellectual property#

The Service, including the App, its software, design, text and graphics, the QuizWhiz name and logo, and the Whiz mascot, belongs to QuizWhiz or its licensors and is protected by intellectual property laws. Subject to these Terms, we give you a personal, non-transferable, non-exclusive, revocable license to use the App on Apple devices you own or control, as permitted by Apple's usage rules, and to use the Web App in a supported web browser. We keep all rights not expressly granted.

9. Feedback#

If you send us ideas or suggestions, we may use them to improve QuizWhiz without owing you anything. Thank you, we read everything.

10. Third-party services#

The Service relies on, and links to, services we don't control, such as Apple, Google, our payment partners, YouTube and websites you share. Your use of them is governed by their own terms and privacy policies, and we are not responsible for them.

11. Changes to the Service#

We are always improving QuizWhiz, so features may be added, changed or removed. We try to keep the Service available, but it may sometimes be interrupted for maintenance, updates or reasons outside our control. If we stop offering the Service altogether, we will give you reasonable notice where we can.

12. Suspension and termination#

You can stop using the Service and delete your account at any time. We may suspend or end your access if you seriously or repeatedly break these Terms, if the law requires it, or to protect other users or the Service. Where reasonable, we will tell you why and give you a chance to fix the problem. Deleting your account does not cancel an App Store subscription, so cancel it in your Apple ID settings too. If you subscribed in the Web App, cancel your subscription from your account there before deleting your account. Sections that by their nature should survive termination will continue to apply.

13. Disclaimers#

To the fullest extent the law allows, the Service is provided “as is” and “as available,” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not promise that the Service will be error-free or uninterrupted, or that it will lead to any particular grade or result. Some places do not allow these exclusions, so some of them may not apply to you.

14. Limitation of liability#

To the fullest extent the law allows, QuizWhiz will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost data, profits or grades, arising from or related to your use of the Service. Our total liability for any claim relating to the Service is limited to the greater of the amount you paid us for the Service in the 12 months before the claim, or US$50.

Nothing in these Terms limits liability that cannot be limited by law, such as for fraud, or for death or personal injury caused by negligence. It also does not affect any rights you have as a consumer that cannot be waived by contract.

15. Disputes and governing law#

If you have a problem with QuizWhiz, please contact us first at support@quizwhizai.com. Most issues can be sorted out quickly, and we will try in good faith to resolve yours within 30 days. If we can't, either of us may take the dispute to the courts that have jurisdiction. These Terms are governed by the laws of the place where you live, without regard to its conflict-of-law rules. Nothing here takes away the protection of mandatory consumer laws where you live.

16. Apple App Store terms#

If you got the App from Apple's App Store, you and we both acknowledge that:

• These Terms are between you and QuizWhiz only, not Apple, and QuizWhiz alone is responsible for the App.
• Apple has no obligation to provide maintenance or support for the App.
• If the App fails to meet any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any). To the maximum extent the law allows, Apple has no other warranty obligation for the App.
• Apple is not responsible for any claims relating to the App, including product liability claims, claims that the App fails to meet legal or regulatory requirements, and consumer protection or privacy claims.
• If a third party claims that the App or your use of it infringes their intellectual property rights, QuizWhiz, not Apple, is responsible for investigating, defending, settling and discharging that claim.
• You confirm that you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and that you are not on any U.S. Government list of prohibited or restricted parties.
• Apple and its subsidiaries are third-party beneficiaries of these Terms, and once you accept them, Apple has the right to enforce them against you as a third-party beneficiary.

17. Changes to these Terms#

We may update these Terms from time to time. We will post the new version here and update the effective date. If a change is significant, we will tell you in the App, the Web App or by email before it takes effect. If you keep using the Service after the changes take effect, you accept the updated Terms. If you don't agree, stop using the Service and delete your account.

18. General#

These Terms, together with our Privacy Policy, are the whole agreement between you and QuizWhiz about the Service. If any part is found unenforceable, the rest stays in effect. If we don't enforce a right, we are not waiving it. You may not transfer your rights under these Terms without our consent. We may transfer ours as part of a merger, acquisition or sale of assets.
